Due to the personal responsibility expressly laid down in the NIS-2 Implementation Act and the associated explicit personal (!) liability of management, one can no longer avoid the issue of IT security. In the event of violations, there is a risk of high fines of up to € 20 million.

All companies falling within the special scope (critical or important healthcare and life science facilities including its industry) are obliged to implement the new NIS-2 guidelines includes various requirements in the area of IT security, in particular the implementation of robust risk management measures in technical, operational and organizational form in accordance with international standards.

Unlike the GDPR, for example, the NIS-2 directive contains an explicit catalog of minimum measures that must be implemented. This includes, for example, procedures to prepare and deal with security incidents, processes for securing supply chains or measures for dealing with vulnerabilities. This also includes timely reporting of security incidents to authorities or urgently necessary emergency operations.
